Terms & Conditions
Please read these terms carefully before engaging our inspection services. By booking an inspection, you agree to be bound by the following terms.
1. Definitions
In these Terms and Conditions:
- “We” / “Us” / “Our”— means 786 Pty Ltd Trustee for Fida Shah Family Trust trading as Victoria Pre-Purchase Home Inspections (VPHI), its employees, agents, and contractors.
- “Client” / “You”— means the person or entity who engages VPHI to conduct an inspection and to whom the report is addressed.
- “Property”— means the residential property to be inspected as agreed at the time of booking.
- “Report”— means the written inspection report issued by VPHI following the on-site inspection.
- “Inspection”— means the visual assessment of accessible areas of the Property conducted by our qualified inspector.
2. Scope of Inspection
The inspection is a visual assessment only of the accessible structural and non-structural elements of the Property. The inspection is conducted in accordance with Australian Standard AS4349.1-2007 (Inspection of buildings — Pre-purchase inspections — Residential buildings).
The Report is prepared exclusively for the named Client and reflects the condition of the Property at the time of inspection only. It cannot be relied upon by any third party without our written consent.
The following are expressly excluded from the scope of our inspection:
- Electrical systems (specialist)
- Plumbing systems (specialist)
- Asbestos identification or testing
- Environmental hazards
- Boundary or land surveying
- Pest and termite inspection (not currently offered)
3. Access & Limitations
The inspection covers only those areas of the Property that are safely and reasonably accessible at the time of inspection. Our inspector will not move furniture, appliances, stored items, floor coverings, or personal belongings.
Areas that are concealed, locked, inaccessible, or unsafeto access — including but not limited to roof spaces without safe access, sub-floor areas with insufficient clearance, or areas behind built-in fixtures — will be noted in the Report as “not inspected” and are excluded from the scope.
The Client is responsible for ensuring that the inspector has reasonable access to the Property on the agreed date and time. If access is restricted and the inspection cannot be completed as planned, VPHI reserves the right to charge a return visit fee.
4. Inspection Report
The Report will be delivered to the Client via email as a PDF document within 24 hours of the on-site inspection, unless otherwise agreed. The Report includes photographic evidence of defects and conditions observed during the inspection.
The Report is prepared for the named Client only. VPHI does not accept responsibility or liability for reliance on the Report by any third party. The Client may share the Report with their legal or financial advisors for the purposes of the property transaction.
Our inspector is available by phone to discuss the findings and answer questions following delivery of the Report.
5. Confidentiality
All information provided by the Client in relation to the booking and the Report is treated as confidential and will not be disclosed to any third party without the Client's written consent, except where required by law.
VPHI may retain copies of the Report and inspection data for its records, quality assurance purposes, and to meet regulatory or insurance obligations.
6. Limitation of Liability
Our inspection is a visual assessment only and does not include invasive, destructive, or specialist testing. VPHI will exercise reasonable skill and care in conducting the inspection and preparing the Report.
Our total liability to the Client arising from or in connection with the inspection and Report — whether in contract, tort, negligence, or otherwise — is limited to the fee paid by the Client for the inspection service.
VPHI is not liable for any defects that were concealed, inaccessible, or not reasonably identifiable through a visual inspection at the time of the assessment. VPHI is not liable for any consequential, indirect, or economic loss arising from the Client's reliance on the Report.
7. Payment Terms
Full payment is required before the inspection report is released. You will be invoiced after your inspection is confirmed.
Payment must be made via bank transfer or credit card. A tax invoice will be provided upon confirmation of your booking. The quoted price is exclusive of GST, which will be added at the applicable rate.
If payment is not received within 7 days of the invoice date, VPHI reserves the right to withhold the Report and/or charge interest on the outstanding amount at the rate of 2% per month.
8. Report Validity
The Report reflects the condition of the Property at the date and time of the inspection only. Building conditions can change due to weather, ageing, settlement, water events, or other factors. VPHI makes no representation about the future condition of the Property.
If a significant period of time has elapsed since the inspection (generally more than 30 days), or if the Property has been subject to adverse weather or other events, we recommend a re-inspection before relying on the original Report for any transaction.
9. Disputes & Complaints
Any dispute or concern regarding the Report or the inspection must be raised in writing within 30 days of the date of the Report.
If you have a concern about the accuracy or completeness of your Report, please contact us at info@victoriainspections.com.au with a written description of the issue. We will investigate and respond within 10 business days.
Where a dispute cannot be resolved through direct communication, both parties agree to attempt mediation before commencing any legal proceedings. Any mediation will be conducted in Melbourne, Victoria, in accordance with the mediation rules of the Resolution Institute.
These Terms and Conditions are governed by the laws of the State of Victoria, Australia. Both parties submit to the exclusive jurisdiction of the courts of Victoria.
10. Cancellation Policy
Cancellations made with 24 hours or more notice prior to the scheduled inspection will receive a full refund of any fees paid.
Cancellations made with less than 24 hours notice may incur a cancellation fee of up to 50% of the quoted inspection fee to cover costs associated with scheduling and travel.
If VPHI is unable to conduct the inspection due to circumstances beyond our control (e.g., access denied by vendor, severe weather), the inspection will be rescheduled at no additional cost.
11. General Provisions
Entire Agreement: These Terms and Conditions, together with the booking confirmation and any specific terms agreed in writing, constitute the entire agreement between VPHI and the Client.
Severability: If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
Amendments: VPHI reserves the right to amend these Terms and Conditions at any time. The version in effect at the time of your booking will apply to your inspection.
